Pearson Housing Terms of Service
Please review these Terms of Service ("Terms") carefully, as they contain vital information regarding your legal rights, remedies, and responsibilities. By accessing or using the Pearson Housing Booking Form, you agree to adhere to and be bound by these Terms.
The person making the booking will be referred to as the 'Customer,' and Pearson Housing will be referred to as the 'Landlord.' The Customer acknowledges that once this booking is completed, and the security deposit is received by the Landlord, their reservation for the rental property will receive priority as per the booking.
The Landlord has the authority to collect, use, and disclose the information provided in the booking to assess the Customer's creditworthiness, facilitate leasing, selling, or financing of the property, or for any other appropriate use of the provided personal information by the Landlord and/or its agent.
The Customer confirms that all statements made in the booking are accurate and truthful. The Customer is informed that a consumer report containing credit and/or personal information may be utilized in connection with this booking request. The Customer authorizes the verification of the information provided in this booking request, including information obtained from personal references.
This booking request does not constitute a Rental or Lease Agreement. If the Landlord does not accept this booking, any payment made will be fully refunded. A binding rental agreement will be contingent upon the Landlord's acceptance of the booking request and the Customer entering into a rental/lease agreement with the Landlord in accordance with the booking request. If the Landlord approves the booking request, the Customer will be required to sign a rental/lease agreement (in compliance with local regulations) for the property. If there is any inconsistency between the terms of this booking request and the rental/lease agreement signed by the parties, the terms of the rental/lease agreement will prevail. In the event that the Customer signs a rental/lease agreement and the unit is unavailable on the agreed-upon start date due to a prior tenant holding over, the Customer's remedy will be limited to a refund of the security deposit and any advance payment made.
Pearson Housing reserves the right to modify these Terms at any time in accordance with this provision. If changes are made to these Terms, we will post the revised Terms on the Pearson Housing website and update the "Last Updated" date at the top of these Terms. Additionally, we will notify you of the modifications by email at least thirty (30) days prior to their effective date.
